We all have the right to feel safe and protected in our places of work. The law in England and Wales UK law imposes strict duties on employers to protect their workers from injury, including deliberate acts of violence such as assault or abuse in the workplace.
The Health and Safety Executive (HSE) defines a workplace assault as “any incident in which a person is abused, threatened or assaulted in circumstances relating to their work”. This includes racial, sexist and homophobic verbal abuse – in other words, it does it not limited to physical assault.
Employers who fail to address or minimise the risk of violence against their workers may be liable if such occurrences take place in the workplace.
If your employer knew, or should have known, that there was a risk of assault or abuse and failed to take reasonable steps to avoid you being hurt, you may be able to claim compensation.
