Many people would like their home to pass to their children and grandchildren
From our many years of experience, we know that most people would like their home to pass to their children and grandchildren. However, there are times, even when a valid will is in place, when that might not happen. Indeed, there might be numerous reasons why the family home might be lost to a third party.
This is why we encourage our clients to consider a Home Protection Trust: it involves putting your residential property into a trust, held by trustees (usually children) for you (the settlor).
Whilst the trustees are the ‘owners’ of the property, the settlor has a guaranteed right of residence for the duration of their life. There are no circumstances whereby the trustees can evict the settlor.
